THE CONSTITUTION OF SMOKERS ASSOCIATION

PREAMBLE

SMOKERS ASSOCIATION is an international non-profit organisation in support of human rights and, in particular, but not limited to, in defence of those who expect from life the freedom to smoke, drink, eat and to enjoy personal lifestyle choices without restrictions or interferences.

Our community is equivalent to the International Smokers Club (ISC), having its locations, sites, restaurants, clubs, bars, hotels, halls, but not limited to, open as a whole and equally to smokers and non-smokers, without making any difference between them with the purpose of impose or forbid behaviours.

The Association's name reflects the organisation's original intent when it became clear that smoking repression, and the use of junk science to justify it, was going well beyond the petty prohibition to smoke in public, and implied instead a fundamental subversion of professional ethics and social values on an unprecedented scale.

The message of SMOKERS ASSOCIATION is based on the values of liberty for every individual in his personal choices. In this regard, SMOKERS ASSOCIATION intends to expose the illogic way of thinking used in an unethical manner to present scientific researches, medical and political messages, which wastes great human resources and energy in non-essential and irrelevant endeavours.

Smoking prohibition and the campaigns for behaviour modification are a front to hide the self-satisfaction of those who feel entitled to enforce advice on health, choices, behaviours and social values. Furthermore, health campaigns cover the reasons of those who want to impose their ways with laws, programming the lives of individuals disregarding the values that many people hold precious, and of those liberties and pleasures which are as essential to the political and psychological well-being of people in a free society as health is to the well-being of the body.

Therefore, in order to generally counter these unacceptable tendencies and socio-political trends in contradiction with The Universal Declaration of Human Rights, and
- To improve the efficiency of the movement against governments' immixtures in the control and imposing of the lifestyle;
- To oppose the use of unethical science and misrepresentation of scientific evidence by private and public institutions;
- To educate people about the real meaning and limitations of scientific data, and its appropriate use in public policy;
- To protect and ensure a future of public honesty and personal liberties for this and future generations;

CONSTITUTION OF SMOKERS ASSOCIATION

PRINCIPLES

ARTICLE 1 - SMOKERS ASSOCIATION is based on the fundamental principle, essential to human dignity, that all the people have the right to individual self-determination (The Universal Declaration of Human Rights, Articles 18 and 19). All individuals have the right to exercise self-control over their own lives, and have the right to live in whatever manner they choose, so long as they do not forcibly interfere with the right of others to live in whatever manner they choose.

ARTICLE 2 - The function of any government, in whole or in part, whether local, national, or trans-national, is to manage order and justice with an essential number of laws, and not to establish, enforce, influence, mandate or forbid opinions, trends, culture, values, lifestyle and habits of the citizens, nor to regulate them in any way, with only exception, when irrefutable evidence exists that those opinions, trends and values may expose other citizens to risk without their consent.

ARTICLE 3 - No government has the right to dispose of the lives of humans and of their labour's fruits, nor to impose or forbid behaviours other than aggressions against another person or his property.

ARTICLE 4 - As the government is not an individual, it has no rights whatsoever, but only duties and responsibilities, been the servant of the citizen and not vice-versa.

ARTICLE 5 - Based on the above principles and The Universal Declaration of Human Rights, we support:

  5.1 - The right to liberty of speech and action. We actively support the freedom of speech and press, and oppose censorship and information manipulation in any form.

  5.2 - The right of advertisement, free expression and promotion. We actively support the freedom to advertise, free expression and the promotion of industries, individuals, groups of individuals or ideas whether or not they are considered incorrect, unhealthy, or even dangerous by others, as these are a rights, thus not subject to democratic rules. Accordingly, we oppose all attempts to regulate or forbid advertisement and promotion of legal products and legal behaviours.

  5.3 - The right to property. We actively oppose any government or third party interference with private property and eminent domain.

  5.4 - The right to choose, and to act consequently. We actively support the principle that no one is to be discriminated against, segregated or punished for own convictions, and thus for the chosen way of life related to those convictions, so long as that way of life does not bring clear and present harm to others.

  5.5 - The right to lifestyle. We actively support the right of the consenting adult to whatever chosen lifestyle or habits, including smoking, drinking, dietary or sexual habits.

  5.6 - The ownership of physical life. Any person is the owner of his/her own body, and has the fundamental right to manage and control the own physical life and health. Therefore, we actively oppose all attempts to mandate, forbid, and regulate the managing of one's own physical life, regardless of the soundness of any moral principle or scientific reality.

  5.7 - The right to parenthood. We actively support the right of parents to be parents, sharing their values, experience and perspectives on the world to their children. Accordingly, we oppose any interference in schools or elsewhere to indoctrinate youth with lifestyles, behaviours and other values which may be in conflict with values held by the families, traditions or cultures to which those youth may belong. The main function of schools is to be academic, not political.

People should not be forced to sacrifice their lives, lifestyle and property for the benefit of others. They should be left free, without any interference, to deal with one another as free traders; to choose their lifestyles as they whish; to act upon their own life as they see fit; to educate their children as they see fit; and to create, promote and consume intellectual and physical products as they see fit.

ARTICLE 6 - As governments cannot interfere with the social, economic, and value systems of the citizens, public policies must by no means be based on doubtful science, as indemonstrable facts or group opinions, and which is not conducted according to the stringent rules of the scientific method. Any warning, campaign, prohibition or obligation based on pseudo-science or group opinion is to be disregarded, as it is construed as a clear violation of the individual rights above.

ARTICLE 7 - Tax monies and government power cannot be used to protect people from themselves, as is the case when target groups are taxed to finance propaganda against themselves and their own choices, values and lifestyles, in order to manipulate the lifestyle choices of individuals, which is contrary not only to personal liberty but also to moral law.

ARTICLE 8 - We clearly reject the preventive principle as an immoral and unlawful abuse of state power, as it justify propaganda, prohibition, regulation and taxation on the basis of suspicion and opinion rather than science and justice.
